License and Terms of Use

These license terms are an agreement between you and Omega Technical Systems, LLC (the "Author") concerning this software product. The terms also apply to any updates, supplements, Internet-based services, and support services. By installing or using this software, you accept these terms.

1. Installation and Use. The software is solely owned by the Author and is not public domain software. Permission is granted to individuals to use the software free of charge for private, home use without commercial gain. Use of the software in any other environment, including use by a business or organization of any kind (whether or not it is nonprofit and with or without commercial gain) is forbidden without the prior written consent of the Author.
2. Scope of License. The software is licensed, not sold. Using the software for any purpose other than what is expressed in its documentation, including but not limited to the following, is strictly forbidden: (1) disassembling, decompiling, or reverse engineering any of its components or otherwise reconstituting or obtaining source code for the purpose of modifying the software's behavior or for distribution; (2) modifying the behavior of the software by altering any of its components; (3) intentional misuse that may cause damage to others.
3. Redistribution. Permission is granted to redistribute the software if all of the following conditions are met:
   1. The software is distributed in its original, unmodified form.
   2. There is no misrepresentation of the author or origin of the software. (For example, you may not state or suggest that you wrote the software.)
   3. Either (1) the product is distributed free of charge; or (2) the product is distributed at a reasonable fee that is clearly associated with distribution, and any packaging or advertisement clearly expresses that the product itself is available free of charge.
   4. There is no intention to violate, or to promote or further a violation of, the terms of this license agreement.
4. Disclaimer of Warranty. This product is provided "as-is" without any express or implied warranty or guarantee of any kind. If you install or use the software you bear all risks associated with its installation and use. In no event shall the Author or any representative thereof be held liable for any damages arising from the installation or use of the software, including intentional or consequential damages resulting from its use or misuse by you or a third party, even if the Author is aware of the possibility of such damages. To the extent permitted by law, the Author excludes the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
5. Indemnification. In the event that any of the terms of this agreement are violated, the Author shall have no liability for any direct or indirect damages to you or any third party, and the party or parties responsible for the violation(s) shall indemnify and hold harmless the Author for any damages.
6. Remedies and Damages. In the event that the Author is found legally liable for damages, you can recover from the Author only direct damages not to exceed U.S. $5.00 (five dollars). You cannot recover any other damages, including consequential, lost profits, special, indirect, or incidental damages. This limitation applies even if the Author knew, or should have known, about the possibility of the damages.
7. Severability. If any provisions of this agreement are found to be unlawful or unenforceable, all other provisions shall remain in full effect.
8. Entire Agreement. This agreement, along with the terms for updates, supplements, Internet-based services, and support services that you use, are the entire agreement for the software and services.
